DMCA Policy

At Peanut Butter Cup Banana Soft Serve, we respect the intellectual property rights of others and expect our users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for reporting copyright infringement and for submitting counter-notifications regarding content hosted on our platform.

We comply with the provisions of the DMCA (17 U.S.C. ยง 512), which provides a mechanism for copyright owners to notify online service providers of alleged copyright infringement.

Filing a Notice of Copyright Infringement

If you are a copyright owner or an agent thereof and believe that any content on the Peanut Butter Cup Banana Soft Serve website infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Filing a Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you have the right to file a counter-notification. To do so, you must provide our Designated Copyright Agent with a written counter-notification containing substantially the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Peanut Butter Cup Banana Soft Serve may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party and inform them that we may restore the removed material or cease disabling access to it in 10 business days. Unless the copyright owner files an action seeking a court order against you, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at our sole discretion.
